According to Willis research, the situation is going to  get worse and have a broader impact on businesses.  To me the picture  can\u00e2\u20ac\u2122t be any clearer, now is the time to assist your clients in development  and execution of their environmental Management Strategy (eMS).<\/font><\/p>\n<p><font face=\"verdana\">As the general public becomes  environmentally educated through issues like SOX, FIN 47, ISO 14000,  to name just a few, they are going to make businesses more accountable.   A business utilizing an eMS will be positioned to profit while the environmentally  reactive business will be scrambling for survival.  Assisting your  client&#8217;s with development and execution of their eMS makes you an  indispensable professional.  <\/font><\/p>\n<p><font face=\"verdana\">Willis points out one of the  main benefits a business needs to consider in evaluating environmental  insurance as part of their risk transfer strategy, defense coverage.   Most environmental insurance policies come with defense coverage.   The Willis research comments that defense can be the number one cost  item a business can face in dealing with their environmental issues.<\/font><\/p>\n<p><font face=\"verdana\">There are two other primary  benefits I feel need to be considered as part of a business risk transfer  strategy.  First, all environmental insurance comes with specialists  to assist in handling a claim.  Any time you can have the federal,  state and local governments along with the press pounding on your door  you need a claims specialist who can run damage control central.   Another benefit is a major percentage of the time the cost to remediate  (clean up) the environmental problem is far less than the claims that  come in from third parties, mainly for business interruption.<\/font><\/p>\n<p><font face=\"verdana\">Very few businesses can afford  to self insure their environmental liabilities and yet the majority  of businesses are unknowingly doing just that.  Keep in mind, if  you do not assist your client&#8217;s in proactively addressing their environmental  issues, when they have an environmental claim, the only insurance they  may have is your professional liability insurance.<\/font><\/p>\n<p><font face=\"verdana\">If you did not get my three  part email series on how environmental liability creates change and  profiting in today&#8217;s business environment send me an email and I will  forward it to you.  You can also find it on <a href=\"http:\/\/www.estrategist.com\/\" target=\"_blank\">www.estrategist.com<\/a>.  <\/font><\/p>\n<p><font face=\"verdana\">Iondon, UK, July 31,2006 \u00e2\u20ac\u201d  Environmental claims are increasing in terms of both frequency and magnitude  of loss and this trend looks set to continue, according to insurers  surveyed in the latest Willis Index for Environmental Insurance. Respondents  to the Index for the second quarter of 2006 indicated that the pace  of claims seen recently is higher than in previous years due to the  rapidly changing environmental legislation and the increasing public  awareness of environmental issues.<\/font><\/p>\n<p><font face=\"verdana\">The Willis Index provides a  quarterly update on a range of issues affecting the London underwriting  market, based on a survey of insurers within various specialty lines,  including environmental.<\/font><\/p>\n<p><font face=\"verdana\">Insurers report that the vast  majority of recent claims have been successful, perhaps largely due  to the specialist nature of the cover. Where claims did not succeed,  this was typically a result of the (often innocent) non-disclosure of  &#8220;known&#8221; contamination issues prior to binding the policy, as well  as other policy exclusions. Both issues highlight the need to use a  specialist broker such as Willis who is familiar with policy wording  and disclosure requirements.<\/font><\/p>\n<p><font face=\"verdana\">The payment of valid claims  is of course a fundamental aspect of the environmental insurance market.  In Willis\u00e2\u20ac\u2122 experience, the tight drafting of policy wordings and good  understanding of the technical, legal and commercial issues are essential  ingredients in the negotiation of an effective environmental insurance  placement and the subsequent payment of claims. Environmental insurers  recognise that effective and fair claims management is important in  demonstrating the value of environmental insurance, one insurer commenting:  &#8220;We simply cannot afford to be seen as an industry that does not pay  claims.&#8221;<\/font><\/p>\n<p><font face=\"verdana\">There seems little doubt that  claims are on the increase, and that this looks set to continue. Increased  public awareness of environmental issues brings with it increased potential  for litigation action \u00e2\u20ac\u201d a trend that has been evident in the US for  some years but which is now starting to be seen elsewhere as well. Even  if such litigation ultimately fails, the cost of defending the claim  can be substantial. Indeed, the provision of legal defence costs was  considered by environmental insurers to be one of the main exposures  they face, but also one of the benefits they can bring to an insured.  One environmental insurer commented, &#8220;The coverage for legal defence  expenses under our policies is often overlooked by clients, but it can  add real value to their risk management programme, irrespective of whether  a third party claim or regulatory action succeeds.&#8221;<\/font><\/p>\n<p><font face=\"verdana\">While the premium rating procedures  of environmental insurers have traditionally been based largely on US  claims statistics, most insurers interviewed confirmed that the procedures  are increasingly tailored to the European claims experience and regulatory <\/font><\/p>\n<p><font face=\"verdana\">framework. This, in combination  with the increasing competition throughout the environmental insurance  industry, may have had a hand in driving premiums down recently.<\/font><\/p>\n<p><font face=\"verdana\">But what does the future hold?  The claims seen so far are almost certainly the tip of the iceberg,  particularly in view of the rapid pace of environmental legislation,  coupled with increasing public awareness of environmental issues. Insurers  obviously need to continue to offer attractive cover to clients, but  also ensure that such cover is based on sound underwriting practice.
